1. Introduction and Acceptance of Terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Orlov Maxim PFA, a sole proprietorship registered in Romania (“IceBuddy,” “we,” “us,” or “our”). These Terms govern your access to and use of the IceBuddy mobile application for iOS (including its watchOS companion app), the website at icebuddyapp.com, and all related services (collectively, the “Service”).

By creating an account, downloading, installing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (available at https://icebuddyapp.com/privacy/). If you do not agree to these Terms, you must not use the Service.

We reserve the right to modify these Terms at any time. Updated Terms will be posted at https://icebuddyapp.com/terms/ with a revised “Last Updated” date. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.

2. Eligibility

You must be at least 16 years of age to create an account and use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are between the ages of 16 and 18, you represent that you have obtained the consent of a parent or legal guardian to use the Service, and that your parent or legal guardian has read and agrees to these Terms on your behalf.

We reserve the right to request proof of age or parental consent at any time and to suspend or terminate accounts where eligibility cannot be verified.

3. Account Registration and Security

To access certain features of the Service, you must create an account using a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must notify us immediately at hello@maximorlov.com if you become aware of any unauthorized use of your account or any other security breach.

We are not liable for any loss or damage arising from your failure to protect your account credentials.

4. Description of the Service

IceBuddy is a cold plunge tracking application that allows users to log and monitor their cold water exposure sessions. The Service is available as an iOS mobile application with a watchOS companion app.

The Service includes, but is not limited to, the following features: logging cold water exposure sessions (cold plunges, cold showers, and outdoor cold water immersion); recording session data including water temperature, duration, and heart rate (when available via Apple Health); measuring water temperature using the Apple Watch’s built-in sensors via CoreMotion (when enabled by the user); retrieving outside temperature data based on approximate location via Apple WeatherKit; integrating with Apple Health to store sessions as mindfulness and/or workout activities; offline functionality with local data storage synced via PowerSync; social features including public and private user profiles, comments, and reactions; and sharing cold plunge sessions to Instagram, Facebook, or saving as images.

Certain features of the Service require a paid subscription. Details regarding subscription features, pricing, and billing are set forth in Section 6.

5. Health and Safety Disclaimer

IMPORTANT: PLEASE READ THIS SECTION CAREFULLY.

Cold water immersion carries inherent health risks, including but not limited to hypothermia, cold shock response, cardiac arrhythmia, loss of consciousness, and drowning. These risks can result in serious injury or death. You should consult a qualified medical professional before engaging in cold water exposure, particularly if you have any cardiovascular conditions, respiratory conditions, circulatory disorders, or other medical conditions.

IceBuddy is a logging and tracking tool only. The Service does not provide medical advice, health recommendations, coaching, diagnoses, or treatment suggestions of any kind. The data displayed in the Service (including water temperature readings, heart rate data, and session duration) is provided for informational and personal tracking purposes only and should not be relied upon for medical decision-making.

Temperature measurements obtained via the Apple Watch CoreMotion sensor or Apple WeatherKit are approximate and may not be accurate. Heart rate data is provided by Apple Health and is not independently verified by IceBuddy.

By using the Service, you acknowledge and accept all risks associated with cold water exposure. You agree that IceBuddy, its owner, and its affiliates are not responsible for any injuries, health complications, or death resulting from your participation in cold water immersion activities, regardless of whether you used the Service to track such activities.

You are solely responsible for your own safety during any cold water exposure activity. Never engage in cold water immersion alone, and always ensure that appropriate safety measures are in place.

6. Subscriptions and Payments

IceBuddy offers both free and paid subscription tiers. Some features of the Service are only available to users with an active paid subscription.

Paid subscriptions are available on a monthly or annual billing cycle. All subscriptions are processed and managed through Apple’s App Store. By subscribing, you agree to Apple’s terms and conditions for in-app subscriptions, including their auto-renewal and billing policies.

Subscriptions automatically renew at the end of each billing cycle unless you cancel the subscription at least 24 hours before the end of the current period. You may manage and cancel your subscription through your Apple ID account settings.

All payments are processed by Apple. We do not directly collect, store, or process any payment information. For refund requests, please contact Apple directly through their standard refund process, as we do not have the ability to issue refunds for App Store transactions.

We reserve the right to change subscription pricing at any time. Any price changes will take effect at the start of your next billing cycle following reasonable notice of the change.

7. User Content

The Service allows you to upload, post, and share certain content, including but not limited to profile pictures, cold plunge photographs, comments, reactions, and biographical information (collectively, “User Content”).

You retain ownership of your User Content. However, by uploading or posting User Content to the Service, you grant IceBuddy a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, display, and distribute your User Content solely in connection with operating and providing the Service. This license continues until you delete the User Content or your account, after which it will terminate within a commercially reasonable timeframe, except where your User Content has been shared with others and they have not deleted it.

When you share a cold plunge session to Instagram, Facebook, or save it as an image, the generated image includes the IceBuddy logo and branding. You may share these branded images on social media and for personal use, but you may not alter, remove, or obscure the IceBuddy branding.

You represent and warrant that you own or have the necessary rights to all User Content you submit, and that your User Content does not infringe the intellectual property rights or other rights of any third party.

You are solely responsible for your User Content. We do not endorse, verify, or assume any responsibility for User Content posted by users. We reserve the right, but have no obligation, to remove or disable access to any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

8. Prohibited Conduct

You agree not to use the Service to: upload, post, or transmit any content that is unlawful, defamatory, harassing, threatening, abusive, obscene, hateful, or otherwise objectionable; impersonate any person or entity, or misrepresent your affiliation with any person or entity; upload or share content depicting minors; stalk, bully, intimidate, or harass other users; use the Service for any commercial purpose not expressly authorized by us, including advertising or solicitation; attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the Service; interfere with or disrupt the integrity, security, or performance of the Service or its infrastructure; use automated means (bots, scrapers, crawlers) to access or collect data from the Service; circumvent or attempt to circumvent any access restrictions, rate limits, or security measures; create multiple accounts for deceptive or abusive purposes; or upload viruses, malware, or other malicious code.

Violation of these prohibitions may result in immediate suspension or termination of your account, at our sole discretion.

9. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, available at https://icebuddyapp.com/privacy/. The Privacy Policy explains how we collect, use, store, and protect your personal data.

By using the Service, you acknowledge that your data is stored on servers located in the United States (specifically, Supabase hosted in the us-east-1 region) and may be processed by third-party service providers, including PowerSync for offline synchronization. As such, your data may be transferred to and processed in jurisdictions outside of the European Economic Area (EEA). We take reasonable measures to ensure that such transfers comply with applicable data protection laws, including the EU General Data Protection Regulation (GDPR). For more information on cross-border data transfers, please refer to our Privacy Policy.

Certain data (including your user profile and cold plunge session data with associated media) is also stored locally on your device to enable offline functionality. This local data is synced with our servers when connectivity is restored.

The Service offers social features including user profiles, the ability to follow other users, and the ability to comment on and react to cold plunge sessions.

You may set your profile to either public or private. With a private profile, your name, profile picture, bio, total number of cold plunges, and follower/following counts remain visible to all users. However, your cold plunge details, comments, follower lists, and following lists are hidden from users who do not follow you. New follow requests to private accounts require your approval. Please note that comments you make on other users’ public cold plunges will be visible to anyone who can view that plunge, regardless of your profile privacy setting.

With a public profile, all of your profile information, cold plunge sessions, comments, and social connections are visible to other users of the Service.

You are responsible for the content you post in comments and on your profile. We do not currently operate a content moderation system. We rely on users to engage respectfully and in good faith. We reserve the right to introduce content moderation, reporting, and blocking features in the future, and to remove content or suspend accounts that violate these Terms.

11. Intellectual Property

The Service, including but not limited to its design, code, graphics, user interface, logos, trademarks, and all other visual and functional elements (collectively, the “IceBuddy Materials”), are owned by Orlov Maxim PFA and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use, subject to these Terms. This license does not include the right to copy, modify, distribute, sell, or lease any part of the Service or the IceBuddy Materials, or to reverse engineer or attempt to extract the source code of the Service.

The IceBuddy name, logo, and all related branding are trademarks of Orlov Maxim PFA. You may not use these marks without our prior written consent, except as expressly permitted in Section 7 regarding branded share images.

12. Third-Party Services and Integrations

The Service integrates with and relies on third-party services, including but not limited to Apple Health (HealthKit), Apple WeatherKit, Supabase, PowerSync, Sentry, RevenueCat, Instagram, and Facebook. Your use of these third-party services is subject to their respective terms of service and privacy policies.

We are not responsible for the availability, accuracy, or reliability of third-party services. We are not liable for any loss or damage resulting from your use of, or inability to use, any third-party service in connection with IceBuddy.

We may add, modify, or remove third-party integrations at any time without prior notice.

13. Beta Features

From time to time, we may offer beta or experimental features within the Service. Beta features are provided “as is” and “as available” without any warranties of any kind. Beta features may be unstable, contain bugs, or be discontinued at any time without notice.

By using beta features, you acknowledge that they may not function as expected and that any data associated with beta features may be lost or corrupted. We are not liable for any loss or damage arising from your use of beta features.

We may collect additional usage data related to beta features to help improve the Service. Any such data collection will be described in our Privacy Policy.

14. Account Deletion

You may request deletion of your account and associated data through the account deletion feature in the app. Upon receiving your deletion request, we will process the deletion of your account and personal data within 30 days.

Please note that following account deletion: your profile, cold plunge sessions, and associated media will be permanently deleted; comments you made on other users’ cold plunges may be anonymized or removed; certain data may be retained where required by law or for legitimate business purposes (such as fraud prevention or legal compliance), as described in our Privacy Policy; and data that has been shared with or copied by other users or third-party services (such as Instagram or Facebook) cannot be recalled by us.

Account deletion is permanent and cannot be reversed. You will need to create a new account if you wish to use the Service again after deletion.

15. Termination and Suspension

We may suspend or terminate your account and access to the Service at any time, for any reason or no reason, with or without notice. Grounds for termination include, but are not limited to: violation of these Terms; conduct that we determine to be harmful to other users, to us, or to third parties; suspected fraudulent, abusive, or illegal activity; or extended periods of inactivity.

We may also suspend or terminate the Service entirely, in whole or in part, at any time and for any reason, including but not limited to a decision to discontinue the Service.

Upon termination: your license to use the Service will immediately cease; you must stop using the Service and delete any copies of the application; we may delete your account and associated data in accordance with our Privacy Policy; and if you have an active paid subscription, you are responsible for canceling it through your Apple ID account settings to avoid further charges.

Sections of these Terms that by their nature should survive termination will continue to apply, including but not limited to Sections 5 (Health and Safety Disclaimer), 7 (User Content), 11 (Intellectual Property), 16 (Limitation of Liability), 17 (Indemnification), and 19 (Governing Law and Dispute Resolution).

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ICEBUDDY, ITS OWNER, AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY DATA (INCLUDING TEMPERATURE, HEART RATE, OR SESSION DATA) WILL BE ACCURATE OR RELIABLE.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

17. Indemnification

You agree to indemnify, defend, and hold harmless Orlov Maxim PFA from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: your use of the Service; your User Content; your violation of these Terms; your violation of any applicable law or regulation; your violation of any rights of a third party; or any injury, death, or property damage resulting from your cold water exposure activities.

18. Disclaimer of Medical Responsibility

IceBuddy is not a medical device. The Service is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The data provided by the Service, including but not limited to water temperature, heart rate, and session duration, is for personal informational purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment.

Always seek the advice of a qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay seeking it because of information obtained through the Service.

19. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of laws provisions.

Any disputes arising out of or in connection with these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Romania.

If you are a consumer residing in the European Union, you retain any mandatory protections provided to you under the consumer protection laws of your country of residence. Nothing in these Terms affects your rights as a consumer under applicable EU law. You may also be entitled to bring proceedings in the courts of the EU member state in which you reside.

European Union residents may also refer disputes to the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.

20. Error Reporting and Crash Data

We use Sentry, a third-party error tracking service, to collect crash reports and diagnostic data for the purpose of identifying and resolving technical issues within the Service. This data may include device information, operating system version, app version, and technical logs related to errors. This data is used solely for debugging and improving the Service and is not used for marketing or advertising purposes.

21. Availability and Modifications to the Service

We strive to keep the Service available and functional, but we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control.

We reserve the right to modify, update, or discontinue any features or aspects of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service or any part thereof.

22. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

23. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Orlov Maxim PFA regarding your use of the Service, and supersede any prior agreements, communications, or understandings, whether written or oral, relating to the same subject matter.
